A NOTICE NEEDS A SPECIFIC RESPONSE

Miami Beach seawall notices

Our checklist does not interpret or replace a City notice. The issuing office must confirm the case, required actions, and applicable deadlines.

Record the essentials

  • Case number, property identification, date issued, and date received.
  • The cited conditions and code sections.
  • Every response, hearing, appeal, permit, and completion date stated.
  • The issuing department and the official contact listed on the notice.

Verify the next action promptly

Use an official City channel to confirm that the notice is authentic, what response is required, and whether a professional assessment is needed. If you dispute it or need legal interpretation, consult an appropriate professional promptly.

Build a case file

Keep a copy of the notice, dated photographs taken safely, correspondence, prior permits, survey records, and any professional reports. Record who you spoke to and the date.

Keep evidence of progress, not just a to-do list

Section 54-63 identifies written contractor proposals, financing arrangements, and permit applications as examples of progress. Keep dated copies and ask the issuing office what evidence your case requires. A proposal or grant application does not extend a deadline or itself resolve the cited condition.

  • Record each action, responsible person, and date.
  • Keep the proposal, correspondence, or application reference that supports the action.
  • Note the next confirmed step and any unanswered question for the City or professional.
  • For urgent mitigation or an unstable edge, seek appropriate City and professional direction; do not enter floodwater or attempt a repair to document progress.

Avoid assumptions about time

The code includes different milestones, including applicable 60-day progress, six-month permit application, and 730-day remedy requirements. Certain mitigation may be required within three days or another specified period, and appeals can have a ten-day deadline. These are not a universal grace period. Verify the precise requirements and dates for your notice promptly; a grant application does not pause enforcement.

Civil penalties follow the notice process

Section 54-65 sets a $250 first civil offense and $500 for second and subsequent offenses. Continuing days can be separate offenses. Appeal, progress, permitting, remedy, and immediate-mitigation dates differ; verify the actual notice rather than assuming a two-year grace period.
